人口結構的變遷與獨居、未婚、無子女老人的增加，未來將導致家庭支持系統功能的弱化，社會支持系統介入之需求將與日俱增。一般非弱勢老人或略有資力之老人，未來如果在欠缺家庭支持系統情 形下失能，為確保其財產安全，需要社會支持系統之介入與服務。就此，除政府主管機關外，相較於營利性組織，非營利之社會福利機構（下稱「社福機構」）可能比較適合扮演介入與提供服務之角色。但社福機構現以弱勢老人為服務對象之服務模式，並無法因應前述社會變遷衍生之服務需求。
監護輔助宣告及信託制度是直接涉及老人財產安全保障的預設制度。本研究首先透過文獻探討，釐清在我國現行法令與制度架構下，社福機構得就老人監護輔助宣告以及老人安養信託提供之服務，以及可能遇到之制度規範上問題；另一方面，檢視外國相關制度之發展趨勢與服務經驗，探究其值得借鏡之處。再進一步藉由質性研究，透過經由深度訪談，以立意取樣方式，訪談民意代表、學者專家、社福機構人員與金融相關機構人員等共七位，瞭解社福機構就監護輔助宣告制度與老人安養信託相關服務之實際操作模式與狀況，暨其遭遇之主要問題。訪談前，會先提供訪談大綱予受訪者並據此進行訪談；訪談後，會依錄音製作訪談紀錄，就受訪人員予以編碼、去識別化。之後，再比對訪談大綱，就訪談紀錄內容進行分類整理與摘要，並參考文獻探討時所得問題，就進行分類與摘要後之訪談紀錄內容進行分析與闡釋。
依研究結果發現，現行法令制度業已允許社福機構提供相關服務，但社福機構提供之相關服務甚為有限，並欠缺對於財產管理之專業能力。就監護輔助宣告部分，多限於和地方政府合作提供服務予弱勢老人；就老人安養信託部分，與受託銀行合作擔任信託監察人之情形亦屬有限。為便社福機構介入提供老人財產安全保障之相關服務，本研究有如下建議：
1.建議地方政府改採特約與支付方式，協助社福機構調整服務模式，以利老人財產安全保障服務之提供。
2.在提供監護輔助相關服務時，應在維護服務對象利益前提下，儘可能尊重個人意願與偏好，以符合聯合國身心障礙者權利公約（下稱「CRPD」）之精神。
3.建議社福機構強化機構人員之跨專業能力。為此，並建議主管機關放寬社福機構服務人員（個案管理員與社工督導等）之資格限制，以便社福機構依服務需求引進不同專業人員提供服務。
4.建議社福機構之服務應有詳細之規劃與紀錄，以強化作業程序之監督，提升服務計畫品質。
5.相關法令之修訂建議：包括將監護人執行職務時之行為基準予以明確化（最佳利益或個人意願與偏好），強化監護輔助職務之監督以及諮詢，介入監護與信託制度之整合，放寬社福機構服務人員資格限制，以及於老人福利法增訂相關規範等。

The changes in the population structure, and the increase in the elderly living alone, unmarried, and childless will lead to the weakening of the function of the family system in the future. Thus, the need for intervention by the social support system will increase. As to the elderly having assets, they need the social support system's assistance in securing and protecting their assets when they are disabled without family support system in the future. In this regard, in addition to the government agencies, compared with profit-seeking enterprises, non-profit social welfare organizations may be more suitable for intervening in and providing services. However, the social welfare organization's current service model may not apply to the service of protection of property in the future.
Guardianship and property trust are mechanisms most related to protection of the elderly’s property. In this research, we first clarified services related to guardianship and property trust which can be provided by social welfare organizations and relevant legal issues encountered by social welfare organizations under the current legal frame and system. On the other hand, by reviewing the legal development trend and service experience of foreign countries, we can explore and find the worthy of reference in this research. Furthermore, through the in-depth interview with 7 persons, including one lawmaker, two scholars and four personnel in social welfare organizations and financial-related institutions, we understood the social welfare organization's actual service model and service conditions of the related guardianship and property trust as well as the problems faced by them. Before the interview, the interview outline will be provided to the interviewee. After the interview, the interview record will be produced based on the audio recording, and the interviewee will be coded and de-identified. Further, the interview records were analyzed and explained by comparing the interview outline, sorting and summarizing the content of the interview records, and referring to the questions obtained during the literature discussion.
This research shows that social welfare organizations are allowed to provide relevant services under the applicable laws. However, relevant services provided by social welfare organizations is limited. Also, social welfare organizations lack professional ability of property management. As to the services related to guardianship, most social welfare organizations cooperate with local governments to provide services to disadvantaged elderly. As to the services related to the elderly's property trust, only few organizations provide services by cooperating with entrusted banks to act as trust supervisors. For social welfare organizations to provide services of protection of property of the elderly, the following matters are advised:
1. It is advised that the local government should change its payment model (payment to contracted organizations for qualified services) to assist social welfare organizations in changing its service model for purpose of providing services related to protection of property of the elderly.
2. To follow the rules of the CRPD, social welfare organization shall do their best to respecting the elderly's personal wishes when providing services.
3. Social welfare organizations should take necessary measures to strengthen the professional capabilities of their personnel in different fields. In this regard, the competent authorities should reduce restrictions on personnel qualification for social welfare organizations to hire and engage different professionals to provide services in different fields.
4. The service plans shall be well planned and prepared with details in order to enhance quality of service plans and supervision on service procedures.
5. Amendment to applicable laws and regulations related to clarifying the standards of behavior of guardians when performing their duties (best interests, or personal wishes and preferences), increasing supervision and assistance in performance of duties of guardianship, intervening in the incorporation of guardianship and property trust by the court, reducing restrictions on qualification of service personnel, and adding relevant rules in the Senior Citizens Welfare Act.
