本文主要探討1994年台灣實施之專利法改革對廠商的研究發展(research and development)支出與專利申請表現之影響,截至目前,關於加強專利保護程度是否鼓勵廠商創新投入與產出之理論或實證研究尚未有一致的結論。本文針對1981年至2019年台灣電子業TEJ上市櫃公司之追蹤資料,並根據台灣經濟部智慧財產局之資料庫,建立廠商的發明專利申請數樣本,運用雙重差分法 (Difference-in-Differences, DID) 以及傾向得分匹配雙重差分法 (Propensity Score Matching with Difference-in-Differences, PSM-DID),以進行實証分析。本研究發現於1994年以前已有申請專利之廠商相較於未申請專利之廠商,台灣專利法改革有利於廠商發明專利申請之表現;然而,專利法改革與研究發展投入的正向關係並不顯著。本研究也發現廠商規模、資本密集度與外資持股比例等特質與廠商創新活動有正向且顯著的關係。
This paper mainly discusses the impact of Taiwan's 1994 patent reform on manufacturers’ research and development expenditure and patent application performance. Up to now, there has not been a consistent conclusion in theoretical or empirical research about whether strengthening the degree of patent protection encourages manufacturers to innovate. This paper focuses on panel data of companies listed on the TEJ market in Taiwan's electronics industry from 1981 to 2019. It creates a sample of the number of manufacturers’ invention patent applications based on the database of Intellectual Property Office of Taiwan Ministry of Economic Affairs. This study uses Difference-in-Differences (DID) method and Propensity Score Matching with Difference-in-Differences (PSM-DID) method to analyze the performance of firms’ innovation activities during this period. Compared with manufacturers that had not applied for patents before Taiwan's 1994 patent reform, patent reform is beneficial to the performance of manufacturers' invention patent applications; however, the positive relationship between patent reform and research and development expenditure is not significant. This study also finds that firm size, capital intensity, and foreign shareholding ratio have a positive and significant relationship with firms’ innovation activities.
