「公共意志」、「國族認同」與「外交承認」奠定了「主權國家」作為唯一正當地行使「對內最高」與「對外獨立」權力的政治形式的正當性基礎；而不具有該身分的政治共同體，其自主性通常就無法被保障，因此大多數政治共同體皆盡力透過達成上述幾點來為自己的權力行為賦予正當性。然而，這個為所有政治共同體嚮往的「主權國家」的政治形式，它的正當性根基是否真的是有道理的呢？

本文第一部分提出：「為何一個結合了”公共意志”、”國族認同”與”外交承認”的”主權國家”，能被視為唯一可以正當地行使主權的政治形式？」的問題，接著藉由對「主權國家」的政治形式做基本說明，以及點出這種形式遭遇的種種現實難題，來重新整理這個問題。
為了回應之，第二部分將探討：「能夠賦予”當代主權國家的政治形式”以正當性的元素之所以被人們所認同」在思想上的源頭。所以，筆者將會藉著韋伯與史密特的眼光，去考察19、20世紀在「科學、宗教、政治與法領域」三個權力運作領域中，其「能夠正當化權力的元素」之所以被人們認同的脈絡，並指出「理性化」與「對理性化的反動」兩驅力的消長與結合關係，很可能正是我們會認同這些元素的重要根源；最後再盡可能地依此來點出改變的可能性。

“General will”, “national identity,” and “diplomatic recognition” play the role that make the political form called “sovereign state” as a legitimate kind of authority with “domestically supreme and internationally independent power”. And without being recognized as a “sovereign state”, a political unity will lack the autonomy to legitimately exercise its political power. That’s the main reason why most political unities strive to display these elements in its political practice. However, does claiming the legitimacy of “the sovereign state” with these elements really make sense?

The first part of this paper brings out the question “why we generally approve of sovereign state deeply related to ‘general will,’ ‘national identity,’ and ‘diplomatic recognition’, as the one and only kind of political form entitled with legitimate sovereign power?”. To clarify this question, I do a brief overview of this political form, and point out practical problems it has faced.

With the goal of answering this question, the second part of this paper undertakes the task of investigating the ideological origin of “we generally approve the elements to have the ability to entitle ‘the sovereign state’ with legitimacy”. I will stand on the shoulders of Max Weber and Carl Schmitt, to research the context of “approving specific elements to have the ability of ‘legitimizing the exercise of power’” in the sphere of “science, religious, polity and law” in 19th and 20th century, and bring out a conclusion that the wane and wax of the drives of “rationalization” and “the reaction of rationalization” might play an important role in the context. Finally, I will try my best to give a rough direction of the possibility to reform.
