摘要
　　在當代社會中，未成年心智障礙女性經常面對各種歧視交織的困境。其中，最受人矚目的議題是其無法自主決定生育一事。和多數國家一樣，台灣透過《民法》及《優生保健法》等法規與相關制度，大幅限制未成年心智障礙者的生育自主權。然而，上述規範限制是否合乎當代人權的標準，實有商榷的餘地。為此，本文從聯合國《消除對婦女一切形式歧視公約》、《兒童權利公約》與《身心障礙者權利公約》等國際人權公約之原則，如不歧視原則、身體不受傷害以及健康權等標準，檢視台灣未成年心智障礙者有關人工流產的法規與制度，例如，《優生保健法》第9條第2項、《民法》行為能力與監護制度、以及知情同意原則。
　　在上述相關國際人權公約標準檢視下，本文認為台灣有關未成年心智障礙者人工流產的規範應遵循《消除對婦女一切形式歧視公約》第1條以及《身心障礙者權利公約》第5條規定禁止對未成年心智障礙婦女的一切歧視。同時，應參照《身心障礙者權利公約》第12條與身心障礙者權利委員會第1號一般性意見，採取人權模式，藉由決策制度保障未成年心智障礙者自主生育意願。此外，為保障未成年心智障礙者平等取得生育保健服務，本文認為台灣應遵循身心障礙者權利委員會第3號一般性意見，加強醫療人員對身心障礙者的生育照護服務，提升對身心障礙者需求的敏銳度，以及確保生育相關資訊的流通。同時，也應遵循《身心障礙者權利公約》第25條，確保未成年心智障礙婦女知悉人工流產的生育保健資訊，使其進行人工流產程序時，處於知情同意之狀態。

Abstract
Female adolescents with intellectual disabilities commonly experience numerous intersectional discriminations in their daily life. A significant difficulty they face is the deprivation by law of their reproductive autonomy. Like most countries around the world, the abortion rules and mechanisms of the Civil Law and Eugenic Health Law in Taiwan impose numerous limitations on the reproductive rights of female adolescents with intellectual disability. However, whether these regulations comply with modern international human rights laws is questionable. This thesis examines the current regulations, abortion rules, and mechanisms in Taiwan involving female adolescents with intellectual disabilities in the context of the human rights principles derived from the United Nations Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW), United Nations Convention on the Rights of the Child (CRC), and United Nations Convention on the Rights of Persons with Disabilities (CRPD). These international human rights standards include the principle of non-discrimination, the right to be protected from being hurt, and the right to health. Among the regulations of Taiwan are Section 2 of Article 9 of the Eugenic Health Law, the legal capacity provisions, the guardianship system in Civil Law, and the informed consent rule.
　　It is argued that Article 1 of the CEDAW and Article 5 of the CRPD, which prevents discrimination against female adolescents with disabilities, should be incorporated into the abortion rules and mechanisms of Taiwan. Further, consistent with Article 12 of the CRPD and General Comment No. 1 of the CRPD Committee, a human rights model that guarantees to female adolescents with intellectual disability having the right to express their will or preference on the abortion process should be adopted.
　　Further, to guarantee that female adolescents with intellectual disabilities have the right to equal access to reproductive health services—based upon the principles of General Comment No. 3 of the CRPD—this thesis also argues that medical services in the reproductive health care system should be improved for providing better reproductive health care to people with disabilities, having more sensitivity to their needs, and ensuring accessibility and transparency of reproductive information. Finally, the principle of informed consent derived from Article 25 of the CRPD should be incorporated into the current abortion rules of Taiwan. This principle ensures that abortion information is delivered clearly to female adolescents with intellectual disabilities; consequently, they are able to realize the risks involved in the whole abortion procedure.
