在以主權國家為單位的世界觀中，國籍與公民身分制度代表著每個人能享有的權利範圍，尤其在全球化時代，基於移民的大量遷徙以及國際趨勢對於普世人權的要求，為避免造成權利分配不均的次等公民現象，開始有打破國家框架的發想，但在面臨極端狀況，例如傳染病肆虐時，國家必須對其國民盡保護義務，在展現主權的同時，政策勢必有他我之分，以我族為優先考量。可見國籍與公民身分的制度，雖然有其悠久的歷史以及難以變動的原則、理論基礎，惟內容其實是動態、複雜且豐富的，隨著國家角色或者社會的演進而轉變。
本論文將檢視我國的國籍與公民身分制度的具體規範，藉由身分的區隔如何將權利作劃分或限縮，規範的背後具有何種意義與動機，規範的傳達出怎麼樣的意識，又造成那些影響。這樣的制度是否能達到國際人權基準，嘗試尋找人權、公民權、國家主權的權衡之道，同時也期許我國在複雜、掙扎又或者分裂的自我認同中，除了維護社會與人民之安全，能有更貼近國人理想，又不違背人權理念的國籍和公民身分制度。

It is commonly conceived that sovereign states are constituents of the world, and nationality and citizenship represent the boundaries within which individuals could enjoy rights and privileges. Especially in the era of globalization, with frequent migration and the even stronger desires to pursue universal human rights, there are intensive calls to evolve beyond the framework of sovereign states to avoid the creation of second-class citizenship caused by uneven distribution of rights due to the boundaries. However, when encountered with extreme situations such as the outbreak of pandemic, sovereign states are obligated to take protective measures over grand of citizenships, and diversified approached are inevitably found in the government policies which may prioritize the classification of citizens.
However, notwithstanding the system of nationality and citizenship has a very long history and its principles and fundamental theories rarely change, the system itself in fact is very vital, complicated and rich, configuring and reconfiguring with the evolving role the states play and the evolution of the society.
This thesis will review the specific regulations pertaining to nationality and citizenship in Taiwan, exploring topics such as how differences in identities can divide or constrain rights; the meaning and rationale behind the regulations; the ideologies conveyed and their impact. This thesis will also explore if the regulations meet global human rights standards, or are they in line with the balance human rights, citizenship rights, and sovereignty, in terms of assisting the island to protect both the wellbeing of its society and citizens amidst her complicated, struggling, and/or divided national identity while formulating a nationality and citizenship regimes, as well as to meet the islanders expectation and in compliance with principles of human rights.
